Hello --

I would like advice re Les's plan to take material from the forums and put it on his radio show without the originator's permission. He says he will do this if there is no copyright "mentioned".
http://electro-music.com/forum/topic-48949.html

My material is all copyrighted as stated on my website, which is the original source.

Do I need to add notices to all my clips posted on the forum? How exactly should I do this? I never anticipated that I would be treated like this on e-m.

There is always a copyright involved. You are protected. And we certainly don´t have any policy of claiming rights to republish stuff from electro-music.com in other media - like print/web to radio. I think I´ll read the Les´s post.

Right, I see your point re your audio files. Good point. These are meant to be instructive within a certain context.

Paul just posted a new topic for the stream operators.. - A "do not play" - list.

That is a neat solution. Very Happy

Thank you. If I could make a suggestion, perhaps Les could invite people to participate in his show? Other circuit developers may not be aware of the potential problems, since the thread has been moved off of the DIY forum.

I´m not really familiar with the Les Hall Show format and content myself, so I have no idea really how the content is treated.

Anyways, the suggestion is excellent. I´m sure having the actual designers on board could be nice, but this is not my show. Very Happy

Hi -- Les has pointed out the following from the terms of use:

"By uploading music and/or sound recordings on the forum of electro-music.com, permission is implicitly granted to electro-music.com to play such media on the site's streaming radio service hosted on radio.electro-music.com. "

So now I'm confused.

Very Happy

The way I understood the proposed format for the show was that Les would talk about circuits and would use posted sound examples with that for illustrative purposes. I've asked Les about this and he said that he did not want to use such examples to make music with. As such, given the the conditions of use for the forum, I do not really see a problem with the show Les proposed.

Well, we have you on our no-play list now. So this must be obeyed no matter what. Nothing to be confused about. Sorry! Very Happy

Yes Ian, thats a part of the conditions of use for the forum that you agreed with when you signed up with the forum.

Paul posted this in the Do not play - topic.

"Ian Fritz has made clear that his audio files are contextual and instructional and are not music. Do not play anything by Ian Fritz until or unless explicit permission for those files is granted."

And that works fine for us.

The "error" we did back then was to not include "complete works of multimedia" - like an article containing images and audio - as one possible type of content. We just thought about music and audio as standalone works.

Our mistake.

Maybe I'm misinterpreting, but he has several times mentioned having clips available for others to incorporate in their music. He said his program would be "one better" than the proposed SoundBites subforum.

Anyway, I get it now, anything I upload is fair game for the radio, according to the rules.

No, as we now clearly make a distinction between "music" and article content like yours.. and we have many members creating that type of content here.

I feel bitter about the treatment that I have received in this situation. I meant no harm to anyone and respected the wishes of others, then I receive negativity in response.

It takes a lot of time and effort to do a radio show and it's an emotional roller coaster ride every show, and I used to make that sacrifice for the fun and community spirit that it fostered.

Maybe I'll feel differently when things cool off a bit and we get stuff like this no play list in place, but as of right now my community spirit is at an all time low.

Les

I don´t think this is about negativity at all. We cleared up an issue we should have properly handled years ago. What happened just now was that Ian and you kicked us into managing this. That is community spirit alright and a good one. Remember that the policy applies to your posts as well. Very Happy An article is an article and can contain illustrations and audio and whatnot.

I agree as for what has been said publicly, however in a private message I received a condescending and insulting remark which really kind of irked me.

Idea That was in a private message that probably should have stayed private. However, the response you got there was partly because we had ignored this issue before.. our bad. Sad
